Terms & Conditions  
INSURANCE CONDITIONS:
Public Liability Insurance(included in the daily rate):
Public Liability Insurance to cover accidents in the event that the renter is at fault. The policy protects the rental company up to US$ 1,000,000 and the renter to Statutory Limits (State mandated minimum liability coverage). Liability Insurance has no deductible and current limits can be checked under the following web-address: http://www.mbainsurance.net/liability_limits.php

Premium VIP Coverage (included in the daily rate); Security Deposit: US$1,000.00 (will be authorized on a major credit card)

VIP includes secondary comprehensive and collision coverage for the rented vehicle with a deductible of US$ 1,000.00 per incident.
Coverage includes but is not limited to:
• Accidental damages to the vehicle (renter’s or 3rd party’s fault).
• “Uninsured Motorist“ in case the renter is involved in an accident with a non-insured driver.
• Windshield & glass damage
• Vehicle theft and fire (personal property and items in the vehicle are always excluded)
• Vandalism

SLI (Supplemental Liability Insurance)
The optional SLI coverage provides the customer with an increased limit of liability protection. SLI protects the renter and any authorized driver listed on the rental contract for up to US$ 1,000,000 toward 3rd party damage claims.

No insurance coverage is provided (liability or comprehensive & collision) while traveling into non-authorized areas including but not limited to the country of Mexico, the inner cities of New York, Montreal and Quebec (Canada).

Non-Covered Damages
Customer has full legal and financial responsibility in case of:
• Renters negligence, e.g. backing up without a guide
• Breach or violation of the rental contract.
• Damages to the interior of the vehicle.
• Damages caused by freezing or overheating of vehicle or systems (please refer to “Winterization” as well).
• Deliberate and willful damages caused by the renter or his guests.
• Damages caused to the vehicle by abuse or misuse for illegal activities.
• Damages caused by neglecting proper operating procedures, e.g. incorrect fuel type & quality, ignoring oil or coolant levels, air pressure etc.
• Damages and losses caused during travel in or thru restricted areas and damages due to “off-road” usage.
• Damages and accidents caused under the influence of alcohol, drugs or other controlled substances.
• Damages and injuries caused by overloading the vehicle and/or exceeding the legal towing capacity (towing limit – 1500lb maximum with proper equipment).
• Carrying more passengers than having seat belts available.
• Operation of the vehicle by anyone not listed on the rental contract or having a valid driver license.
• Operation of the vehicle by anyone not meeting the age requirements as shown on the rate sheets and rental terms & conditions.
• Personal damages and personal property are never covered.

VIP-Vacation Interruption Protection
Should the renter’s motor home vacation be interrupted by an automotive mechanical breakdown (not accident or damages caused by the renter) for more than 12 working hours after reporting such to Road Bear, the renter will be reimbursed for the greater of the gross daily rental rate or expenses for hotel rooms up to US$ 25.00 per person per night and car rental up to US$ 50.00 per day per motor home with a combined maximum of US$ 1,500.00 per tour.

Defects and repairs of radio, TV, CD and DVD player, generator, AC, refrigerator, heater, water heater, slide-out room, awning, cruise control etc. are not considered mechanical breakdowns and are excluded from VIP reimbursement. Refund of expenses is only possible against proper receipts.

Please take note:
In case of a claim, Road Bear RV will not act as an adjuster for any third party insurances purchased by the renter (such as $ 0.00 deductible insurance, etc.).


In the Event of an Accident:
-The customer must obtain a local police report as provided by the attending police officer investigating the accident. An accident report form is supplied to the customer and is located in the vehicle along with the registration- & insurance papers.
-ROAD BEAR RV must be notified as soon as possible. A full-written report along with the other party's name, address, phone number and driver's license number on the supplied accident report form will be required upon return of the vehicle.
-All documents relating to the accident must include a police report- or identifying number.
-Insurance coverage may be void if the above instructions are not followed.

CUSTOMER ORIENTATION:
Staff speaks German & English at all locations - Dutch, French, Italian & Spanish at some locations. After completing the paperwork the clients get a very thorough personal walk-through of the recreational vehicle. In case of an emergency, accident or technical problems, clients may call the emergency toll free number 24-hours a day, 7days a week.

Customer should allow for a minimum of one hour for the paperwork and explanation of the vehicles at time of pick-up. An Operations Manual in English and German is included in every vehicle.

PICK UP / DROP OFF:
All Vehicles are delivered clean (inside & out), with full Gasoline, Propane and Water tanks; First application of chemicals for toilet & toilet paper.

CLEANING FEE:
The clients are responsible to return the vehicle with the interior cleaned and holding tanks
dumped. The vehicle outside does not require cleaning by the customer. Cleaning- and/or dumping charges will apply as posted at the drop off location.

ONE-WAY TRIPS
Upon availability one-way trips are possible between all stations for a one-way fee as specified on the quote. One-way fees will not be refunded in case of cancellation.

MINIMUM RENTAL
-3 nights; 7 nights for one-way rentals

MINIMUM RENTAL - starting April 1, 2011
-3 nights; 5 nights during Holidays; 7 nights for one-way rentals & Burning Man pick up in San Francisco.

DEPOSIT: (authorized/blocked on credit card while traveling): US$ 1000
Additional deposits may be required for special events such as “Burning Man” or if no mileage has been prepaid, etc.

CREDIT CARDS:
VISA-, Master/Euro-, American Express cards are accepted.

BALANCE
The Rental balance of the hire will be deducted from your credit card 35 days before your hire commences, unless there is a cancellation or other arrangements have been made.

REFUND FOR UNUSED PORTION:
No refund on confirmed contract will be given if rental is returned prior to scheduled date, unused mileage or for “no shows”.

CANCELLATION:
Deposit non refundable
- 60 calendar days or more prior to rental date US$ 100.00
- 59 to 30 calendar days prior to rental date 20% of the nightly rental charge plus one-way fee if applicable
- 29 to 15 calendar days prior to rental date 50% of the nightly rental charge plus one-way fee if applicable
- 14 to 0 calendar days prior to rental date 100% of the nightly rental charge plus one-way fee if applicable

*Your credit card will be charged appropriate cancellation fee if you canceled or failed to pick up the vehicle.

CHANGES OF BOOKINGS:
One free change per booking, US$ 50.00 per change thereafter. The Early Bird Discount will be adjusted to the level valid at the time of name, date, vehicle or location changes.

TAXES & GOVERNMENT FEES:
Sales taxes are included for all pre-booked items. Local taxes apply to all pick-up & drop off charges and may change at any time. Newly assessed governmental fees (other than sales tax or DMV fees) not known at this time will be collected from the customer at pick up.

HOLIDAY EVENT RATES/DEPOSIT:
Different Deposit will apply to the following Holidays and Event dates picking up in the following depot locations:

- New York - Dover NASCAR RACE May 13 to 16, 2010
- New York - Dover NASCAR RACE September 23 to 26, 2010
- Las Vegas NASCAR RACE March 3 to March 6, 2011
- San Francisco - Burning Man Festival between August 30 to September 7, 2010. Road Bear will combine the Security & Cleaning deposits for Burning Man and CHARGE (credit card only) a refundable US$1,500 deposit at pick-up.(Please see Terms and Conditions for more info)

Road Bear will not allow name changes on confirmed reservations and the main renter/credit card holder must be present at time of vehicle pick up. Vehicles will not be handed over to 3rd party or in case of insufficient funds for the security deposit. The reservation will be canceled and prepaid funds are forfeit! No exceptions please.

Holiday - 5 Night Minimum Rental Durations:
Labor Day 09/01/10 – 09/07/10 (Except SFO – 7 day minimum / please see above)

TAXES:
Sales taxes are included for all pre-booked items. Local taxes apply to all pick up- & drop off charges and may change at any time. Newly assessed governmental fees (other than sales tax or DMV fees) not known at this time will be collected from the customer at pick up.

***Clients cannot pick up the vehicle the day they arrive from overseas. We recommend that the customers spend the first night at an airport hotel or motel.:

TRANSFERS: Clients cannot pick up the vehicle the day they arrive from overseas or trans-continental and we recommend spending the first night at an airport hotel or motel. Clients must call the rental station upon arrival or on the day of pick up between 08.00 am and 10.00 am at the latest to schedule the transfer time and place. Transfers are provided to (but not from) the international airports LAX/SFO/OAK/LAS/DEN/EWR (not to JFK or La Guardia) and/or from/to airport hotels at all rental locations. In San Francisco/Denver clients will be picked up in downtown and in Los Angeles from Marina del Rey, Venice, Santa Monica for an extra charge.

Transfers will be provided from Monday to Saturday between 11.00 am and 1.00 pm the latest. There will be no transfers after 1:00 pm. The complimentary permitted amount of luggage is in accordance with the airline regulations (2 suitcases @ 50 lbs/23 kg plus 2 pieces of hand luggage per person). Excessive luggage is the customer’s responsibility.

PICK UP AND RETURN:
Vehicle pick up time is between 12.00 noon and 4.00 pm. Vehicle return time is between 8.00 am and 10.30 am. A charge of US$ 30.00/hour applies for a late vehicle return. Clients will not be entitled to get a complimentary transfer after 11 am.

HOURS OF OPERATION:
Monday through Friday from 8.00 am to 5.00 pm, Saturday from 8.00 am to 1.00 pm
(or during season as required). All stations are closed on Sundays and on all statutory holidays.

DRIVER'S LICENSE AND AGE:
A valid national driver's license is required for each driver. In addition we recommend that foreign customers have an international driver's license or an English translation of the license issued by their home country. Minimum of 25 years of age for those with US & Canadian Licenses. 21 years old for other licenses.

Gasoline and Oil:
The cost of propane, gasoline and oil are not included and ROAD BEAR RV does not assume responsibility for estimates of consumption. All vehicles are delivered with full tanks and the customer is expected to return the vehicle with full tanks or will be charged accordingly.

MAINTENANCE:
The customer is responsible for checking engine oil and coolant levels at each refueling as well as reporting mechanical failures immediately. Coolant refills and authorized repairs will be reimbursed upon return of the vehicle and presentation of all receipts (see Mechanical Breakdown). It is the driver's responsibility to operate the vehicle in a safe manner and to exercise all caution possible.

MECHANICAL BREAKDOWN:
For maintenance & repairs exceeding US$ 50.00 the customer must call the ROAD BEAR RV 24-hour toll free telephone assistance to get an authorization. Non-authorized invoices over US$ 50.00 will not be reimbursed. Receipts must be presented for reimbursement. Customer will be held responsible for mechanical damage due to negligence in operation and/or maintenance.

ROADSIDE ASSISTANCE:
Road Bear RV operates a toll free emergency number 24 hours / 7 days a week. Customers may call this number in case of an emergency, an accident or technical problems.

UNAUTHORIZED EXTENSION OF THE RENTAL PERIOD:
Should a customer keep the vehicle beyond the contracted period US$ 30.00 per hour or US$ 300.00 per night penalty fee in addition to the daily rate will apply. However, if the customer contacts ROAD BEAR RV and obtains the proper authorization to extend, the regular rental rate will apply.

Parking/Traffic Violations:
It is the clients responsibility to report and pay for all parking/traffic violations at check-in. Failing to report these violations at drop off will cause a charge of an administrative fee of up to $100.00 plus the fine (including all late charges) to the clients credit card.

Substitution:
If for any reason the booked vehicle should not be available, ROAD BEAR RV reserves the right to substitute a higher-rated vehicle at no additional cost. Should a lower-rated vehicle be substituted, the liability is limited to the refund of the gross rate difference of the two vehicles.

RESTRICTIONS
Pets: Pets are not allowed.
Smoking: Smoking is not allowed in any vehicle. US$ 250.00 cleaning/deodorizing fee applies.
Mexico: Traveling into Mexico is not permitted.
Death Valley: Traveling into Death Valley is not permitted between June 15th and September 15th
Alaska: Traveling within Alaska, Yukon and/or NWT is permitted. ROAD BEAR must be advised at the time of reservation.
Other: Private-, gravel-, dirt- or logging roads and other non-public roads, beaches, etc.
Inner city of New York / Montreal & Quebec City (Canada)

ROAD BEAR RV will hold the customer fully responsible for accidents or mechanical breakdowns occurring in a travel restricted area!

Winterization: Vehicles are winterized between November 1st and March 31st, depending on the pick-up location. It is not possible to use the water-/waste systems during this time or when outside temperatures are below freezing! The water-/waste water system will be drained and CANNOT be used! US$ 100.00 re-winterization fee & damages caused by freezing will be charged if customer de-winterizes system on the road.

NOTE:
International customers shall call the rental station immediately upon arrival but no later than between 8 am and 10 am of the departure day to schedule the pick up. Drop-off time is between 8 am and 10.30 am. Transfer hours are between 11 am and 1 pm and vehicle pick-up time is between 12 pm and 4 pm.

The Los Angeles depot is located in Roadside Drive, Agoura Hills CA 91301 about 39.0 miles or 39 minutes or approximately 2 hours if traffic from Los Angeles International Airport.

Transfers are only available on the following options:
Los Angeles Intl. Airport (LAX) & -hotels (40 miles; free transfer)
Marina Del Rey / Venice (30 miles; US$ 50.00 per trip)
Santa Monica (25 miles; US$ 50.00 per trip)
Downtown Los Angeles (35 miles; no transfer)
